The Weights & Measures Department enforces Ohio law and provides a consumer protection mission for the citizens of Clermont County by ensuring consumers are “getting what they pay for” through the inspection, testing, approval, and sealing of commercial devices used to measure volume, weight, time, and length. The Department also protects Clermont County business owners by ensuring they meet the requirements of Ohio law (Ohio Revised Code) for the sale of product by weight or measure. The work of our Weights & Measures officials assures marketplace equity, discourages unfair competition, and promotes consumer confidence. Devices used for the pricing and sale of products are tested for accuracy and inspected for correctness. The Clermont County Auditor prioritizes the following areas for monitoring and enforcement:
- Retail Motor Fuel Dispensers (gas pumps) – for fuel sold by the gallon.
- Scales (ranging from point-of-sale scales to vehicle scales, deli scales to jeweler scales) – for products sold by the pound or gram.
- Timing Devices (air pumps, laundromat dryers, car wash vacuums, etc.) – for products sold by the second.
- Length Meters – for products sold by the inch, foot, or meter.
- Price Verification – measures shelf tag accuracy and evaluates a retail businesses overall pricing system.
- Bulk Fuel Truck and Rack Meters and LPG Truck Meters: for product sold by the gallon from fuel and propane delivery companies.
Devices are inspected and tested on an annual basis unless more frequent interaction is required. Audits are generally conducted on a non-notice basis. The Clermont County Auditor’s Weights & Measures seal is valid through the end of the following calendar year (i.e., a 2025 seal is valid until 12/31/2026). Weights & Measures services are provided free of charge.
Other areas available for Weights & Measures oversight and enforced on a citizen complaint basis include Packaged Goods Checking, Food Labeling, Firewood, Animal Bedding, Mulch and Soil, and Taxi Meters.
The Clermont County Auditor also provides courtesy testing to non-commercial entities (such as law enforcement, health clinics, wrestling teams, and scouting groups).
Weights & Measures enforcement ideally results in approval and sealing of a device or system. The Inspector will assist the business owner in becoming compliant, as appropriate. If the inspection and test results in a failure or rejection, the Inspector may take the following actions:
- Allow the business to make corrections and submit to a re-audit.
- Issue a Notice of Violation.
- Issue as Stop Sale Order (resulting in the business not being permitted to sell product, be it retail merchandise, gasoline, or anything else).
- Prosecution of non-compliance through the Clermont County Prosecutor’s Office.
